1. Statutory Protections & Fair Trading
These terms operate alongside, and do not override or restrict, your statutory consumer rights under the New Zealand Consumer Guarantees Act 1993 (CGA), the Fair Trading Act 1986, or applicable international consumer protection laws governing your local territory.
2. Pricing and Currency
All prices displayed across our retail, parts, or e-commerce web layouts are listed in New Zealand Dollars (NZD) unless explicitly specified otherwise.
Prices include Goods and Services Tax (GST) unless explicitly stated as GST-exclusive.
We reserve the right to modify machinery, parts, or service pricing at any time without prior notice.
3. Ordering, Specifications, and Acceptance
Submitting an application or order via our parts channels, site forms, or digital touchpoints constitutes an offer to purchase or enquire. We reserve the right to accept or decline any request for reasons including inventory unavailability, configuration errors, regional distribution restrictions, or suspected unauthorized transaction activity.
If a transactional order is canceled after payment has been cleared, we will issue a full refund to your original payment method immediately.
4. Global Logistics & Delivery
Falcon Equipment and Madill components ship directly from our New Zealand and Chile facilities with full documentation and support. We coordinate comprehensive logistics to get your machine operational and ready for the field.
Delivery timeframes provided are estimates only. We are not liable for external shipping, customs clearance, or international marine/air freight delays, but we will actively assist in tracking and resolving delivery disruptions where possible.
5. Returns, Faults, and Remedies
Faulty Equipment or Parts: If a product, mechanical part, or accessory is faulty, damaged, or does not match the professional descriptions provided, we will fulfill our full legal obligations under the CGA and contract laws by repairing it, replacing it, or providing an appropriate refund.
Change of Mind: We are not legally required to provide a refund or replacement if you simply change your mind, choose an incorrect optional spec, or decide you no longer want a configured product. Any exchanges for change of mind remain at our sole operational discretion.
6. Limitation of Liability
To the maximum extent permitted by New Zealand and applicable international law, DC Equipment and its respective brands shall not be liable for any indirect, incidental, special, or consequential damages—including loss of forestry production targets, crew downtime costs, or reduced profitability—resulting from the use of our machinery, parts, or the inability to access our digital platforms.
7. Governing Law
These terms are governed by and construed in accordance with the laws of New Zealand. Any legal disputes arising out of the use of our sites, parts ordering systems, or industrial services will be subject to the exclusive jurisdiction of the New Zealand courts.
